INFORMATION ON THE PROCESSING OF PERSONAL DATA

Kątowa 20, entered in the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the number KRS 0000360290 (hereinafter referred to as: “the Company”).
Data Protection Officer
The Controller has appointed a Data Protection Officer (hereinafter referred to as: “the DPO”). His name is Jacek Skalski. If you are a person representing a Company contractor and designated as a contact person for the Company, your personal data will be processed: (A) for purposes resulting from legitimate interests pursued by the Company, i.e. ensuring contact with the contractor and verifying whether the person contacting the Company is authorised to act on behalf of the contractor, as well as for the purpose of performing the contract between the Company and the entity represented by you and for the purpose of pursuing claims; (B) for the fulfilment of obligations under tax law and accounting regulations; (C) if necessary, for the fulfilment of obligations resulting from whistleblower report services. |

Who will the personal data be transferred to?
The recipients of your personal data may be – only in cases where it is necessary and to the extent necessary – entities cooperating with the Controller in the scope of services provided to the Controller and supporting the Controller's ongoing business processes, in particular entities providing the following services: IT, legal, travel services in connection with the implementation of the the subject matter of the Contract and courier services. In addition, entities for which the Controller provides services as a subcontractor or contractor.
If you are a Website User, your personal data will be stored for the period necessary to achieve the purposes indicated in point 3 of the Company's Privacy Policy Statement.
If you are a natural person owning a sole-trader business aimed at making a contract with the Company, your personal data will be stored for the duration of the contract entered into by you with the Company (if such a contract is actually concluded), and after this period for the limitation period of possible claims.
Furthermore, your personal data will be stored for the period required by tax law, the Accounting Act and, if necessary, the Whistleblower Protection Act.
If you are a representative of a contracting party, your personal data will be stored for the duration of the contract between the contracting party and the Company and, after this period, for the duration of the limitation period for any potential claims.
In addition, your personal data will be stored for the period required by tax law, the Accounting Act and, if necessary, the Whistleblower Protection Act.
What rights do you have in connection with the processing of your personal data?
If you are a Website User, you have the right to:
- access your personal data,
- rectify your personal data,
- delete your personal data,
- restrict the processing of your personal data,
- data portability, including the right to receive the personal data and have it transferred directly to another Controller, or to request the transfer of the data directly to another Controller, where technically feasible (to the extent that the data is processed by automated means for the performance of a contract or on the basis of consent given by the User),
- lodge a complaint with the supervisory body for the protection of personal data,
- object to the processing of personal data (to the extent that the data is processed in the legitimate interest of the Company).

Is it compulsory to provide personal data?
Data about Website Users is provided voluntarily. Providing data is necessary to use the Website.
If you are an natural person owning a sole-trader business, providing personal data is voluntary, but necessary to conclude a contract with the Company.
If you are a person representing a contractor, providing personal data is voluntary, but necessary to make contact with the Company.
PRIVACY POLICY STATEMENT

General information
- This Privacy Policy Statement applies to the personal data of users of websites (hereinafter referred to as ”the User”’) operating at the addresses provided in the “amusys.pl” domain (hereinafter referred to as “the Websites”) and other categories of persons indicated in this document.
- The Controller of the personal data of Website Users is the Service Provider, i.e. Amusys Production sp. z o.o. with its registered office in Zabierzów (32-080) at ul. Kątowa 20, entered in the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the number KRS 0000360290 (hereinafter also referred to as the “the Company”).
- The personal data of Website Users is processed by the Service Provider for the purpose of operating the Website, and in particular:
- A.to ensure the efficient functioning of the Website (in the case of the Service Provider using cookies),
- B.to clarify the circumstances of unauthorised use of the Website (in the case of the Service Provider using cookies,
- C.yo create internal reports and analyses (including statistics on the number of visitors to the Website's subpages) – (if the Service Provider uses cookies),
- D.to improve the quality of the Website (if the Service Provider uses cookies).

Exercise of rights of data subjects

- Every natural person (hereinafter referred to as “the Applicant”) has the right to request the Service Provider to: (A) confirm that the Service Provider processes personal data concerning them, as well as to exercise the right of access to personal data concerning them (consisting of the right of the Applicant to receive a copy of the personal data that the Service Provider processes about them); (B) rectify personal data; (C) erase or restrict processing of personal data; (D) transfer personal data, including the right to receive the aforementioned data and send it to another Controller or to request, if technically possible, send this data directly to another Controller (to the extent that the data is processed by automated means and for the purpose of performing a Contract or on the basis of consent given); (E) object to the processing of personal data (to the extent that the data is processed in the legitimate interest of the Company).
- The above requests will be implemented by the Service Provider in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as “the GDPR”).
- The request to exercise the rights should be submitted in writing to the following address: Amusys Production sp. z o.o., ul. Kątowa 20, 32-080 Zabierzów or by e-mail to the following address: odo@amusys.pl
- In the event that the Service Provider does not process the Applicant's personal data (apart from the fact of processing the aforementioned data for the purposes of the application itself), the application will not be processed and the Applicant's data obtained for the purpose of processing the application will be deleted immediately.
- The Service Provider shall inform the Applicant of this fact immediately after receiving the application and shall include information about the application in their records.
- The Service Provider reserves the right to verify the identity of the Applicant. Failure to effectively verify the identity of the Applicant for reasons for which the Applicant is responsible means that the Service Provider will not process the application and the Applicant will be immediately informed about it.
- The application is processed by the relevant department of the Service Provider without undue delay, but no later than 10 days from the date of receipt of the application by the Service Provider. The procedure for handling the application is consulted with the Company's Data Protection Officer.
- The Service Provider shall provide the Applicant with a response to the request within three (3) weeks at the latest from the date of its receipt. In objectively complex cases (i.e. requiring a large amount of work on the part of the Company), the above-mentioned deadline shall be extended to two (2) months, of which the Applicant shall be informed immediately. At the same time, the Service Provider shall make every effort to ensure that the deadline is not extended as mentioned above.
- As part of the exercise of the right of access to data, the Applicant shall be provided with their data to the extent requested. The scope of information includes:
- the purpose of the processing,
- the categories of personal data being processed,
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular about recipients in third countries or international organisations,
- the planned storage period for the personal data or, if this is not possible, the method of calculating this period,
- if the personal data has not been obtained from the data subject, any available information about its source,
- automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject,
- the right to request the Company to rectify, delete or limit the processing of personal data and to object to such processing (if such a right exists),
- the right to lodge a complaint with the supervisory authority.
- In the case of exercising the right of access to data and the right to transfer it, a copy of the personal data concerning the Applicant is attached to the reply in commonly known and available machine-readable formats.
- Any complaints related to the implementation of this Privacy Policy Statement should be sent to: odo@amusys.pl. The complaint will be considered immediately, but no later than within 10 days from the date of its delivery, of which the Applicant will be immediately informed. The Applicant is also informed about the fact of receiving a complaint. Information about the complaint is entered in the records kept by the Company.

Other provisions

- The Service Provider declares that he or she will endeavour to ensure a high level of security for Users when using the Website. All events affecting the security of information transmission should be reported to the address indicated in point 4 above.
- The Service Provider reserves the right to disclose selected information about the user to the competent authorities or third parties who request such information, based on an appropriate legal basis and in accordance with applicable law.
- Except for the cases indicated in point 17 above, information about the User will not be disclosed to any third party or authority without the consent of the person to whom the information relates.

Cookies and system logs

- The Service Provider informs that, as soon as the User connects to the Website, information about the number (including IP) and type of the User's end device from which the User connects to the Website appears in the Website's system logs. The Service Provider informs that he or she will also process, in accordance with the provisions of applicable law, data regarding the number (including IP) and type of the User's end device, as well as the time of connection of the aforementioned persons to the Website and other operational data regarding the User's activity. These data are processed in particular for technical purposes and to collect general statistical information.
- On selected websites, the Service Provider may use cookies (i.e. small text files sent to the User's device, identifying him or her in a way necessary to simplify or cancel a given operation) in order to collect information related to the User's use of the Website. Cookies enable: maintaining the User's session; adjusting the Website to the User's needs; creating statistics on the views of the Website's subpages.
- The User can change the cookie settings at any time. To do this, the User needs to change the cookie settings in their web browser. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the web browser's settings or to inform the User each time they are placed on the User's device. Detailed information about the possibilities and ways of handling cookies is available in the software (web browser) settings.
